Federal Court Mandates Release of Abrego Garcia from ICE Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to face human smuggling charges, he was held in immigration detention.
In her decision, the court pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
